Mobile Application End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you and Le Studio 316 ("we", "us" or "our"), the publisher of the audibible mobile application (the "Application"). By downloading, installing or using the Application, you agree to this Agreement. If you do not agree, do not download, install or use the Application.
This Agreement is concluded between you and Le Studio 316 only, and not with Apple Inc. or Google LLC. Le Studio 316, not Apple or Google, is solely responsible for the Application and its content.
1. License
We grant you a personal, revocable, non-exclusive, non-transferable and limited license to download, install and use the Application on devices that you own or control, for your personal and non-commercial use, in accordance with this Agreement and with the usage rules of the store from which you obtained the Application (the Apple Media Services Terms and Conditions or the Google Play Terms of Service). Family Sharing or similar store features may allow other accounts associated with you to use the Application where the store permits it.
2. Restrictions
You agree not to:
- copy, modify, translate or create derivative works of the Application, except as permitted by applicable law;
- decompile, reverse engineer, disassemble or attempt to derive the source code of the Application, except as permitted by applicable law;
- rent, lease, lend, sell, sublicense, distribute or otherwise transfer the Application or this license;
- extract, download in bulk, redistribute or publicly perform the audio recordings, texts, images, videos or music made available in the Application;
- remove or alter any copyright, trademark or other proprietary notice;
- use the Application in violation of any applicable law, or to interfere with its operation, security or servers.
3. Content and intellectual property
The Application and its content, including narrations, soundscapes, music, illustrations, videos, texts and software, are owned by Le Studio 316 or its licensors and are protected by intellectual property laws. Some Bible translations, recordings and other materials are used under license from third parties and remain the property of their respective owners. This Agreement does not transfer any ownership rights to you; all rights not expressly granted are reserved.
The Application may include third-party and open source software, which is governed by its own license terms.
4. Accounts
Some features require an account, which you can create with an email address or with Sign in with Apple or Google. You are responsible for keeping your login credentials confidential and for the activity on your account. Please tell us promptly if you believe your account has been compromised.
5. Subscriptions and purchases
Some content and features are available only with a paid subscription or a one-time purchase. Prices and available plans (for example monthly, annual or lifetime access) are shown in the Application before you buy.
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase. Payments are processed by Apple or Google; we never receive your payment card details.
- Subscriptions renew automatically at the end of each period at the then-current price, unless you turn off auto-renewal at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the Application does not cancel a subscription.
- When a free trial is offered, the subscription starts and is charged at the end of the trial unless you cancel before it ends. Any unused part of a free trial is forfeited when you purchase a subscription.
- A lifetime purchase gives access to the premium features of the Application for as long as we continue to operate and distribute it.
- Promotional codes are subject to the conditions stated when they are offered and have no cash value.
- Refunds are handled by Apple or Google under their respective policies. Nothing in this Agreement limits the rights you have under applicable consumer protection law.
6. Privacy
Our Privacy Policy explains how we collect and use personal data when you use the Application. It is available at https://audibible.app/privacy-policy.
7. Updates and availability
We may update, change or discontinue the Application, its content or some of its features at any time. Some content depends on licenses from third parties and may be added or removed. Updates may be required to keep using the Application.
8. Maintenance and support
Le Studio 316 is solely responsible for providing maintenance and support for the Application. Apple and Google have no obligation to provide any maintenance or support services for the Application. For help, contact us at stephane@lestudio316.com.
9. Warranty
The Application is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties not expressly stated in this Agreement. If the Application fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of the Application to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application. Any other claims, losses or liabilities attributable to a failure to conform to a warranty are our sole responsibility, to the extent they cannot be disclaimed under applicable law.
10. Limitation of liability
To the maximum extent permitted by applicable law, Le Studio 316 will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising out of or related to your use of or inability to use the Application. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or willful misconduct and your statutory rights as a consumer.
11. Product claims
Le Studio 316, and not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Application or your possession and use of it, including product liability claims, claims that the Application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
12. Intellectual property claims
If a third party claims that the Application or your possession and use of it infringes that third party’s intellectual property rights, Le Studio 316, and not Apple or Google, will be solely responsible for the investigation, defense, settlement and discharge of that claim.
13. Legal compliance
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
14. Termination
This Agreement is effective until terminated. Your rights under it end automatically if you fail to comply with any of its terms. You may end it at any time by deleting the Application. Upon termination, you must stop using the Application. Sections 3, 9, 10, 11, 12, 16 and 17 survive termination.
15. Changes to this Agreement
We may update this Agreement from time to time. We will publish the new version on this page and update the date at the top. If a change materially affects your rights, we will inform you within the Application or by email before it takes effect. Continuing to use the Application after a change takes effect means you accept the updated Agreement.
16. Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right, and will be deemed to have accepted the right, to enforce this Agreement against you as a third-party beneficiary.
17. Governing law
This Agreement is governed by French law. Before taking any legal action, please contact us so that we can try to resolve the dispute amicably. As a consumer, you may also use a consumer mediator free of charge. If no amicable solution is found, the dispute will be brought before the competent French courts. If you are a consumer residing in another country of the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence and may bring a claim before the courts of that country.
